Terms of Use (EULA)

Auto-renewing subscriptions and purchases in Sleepdrift are governed by Apple's standard End User License Agreement (the Apple Standard EULA), which applies to this app in full. Please read it — by purchasing or using Sleepdrift you agree to it, together with the additional terms set out on this page.

1. Agreement

These Terms of Use ("Terms") govern your use of Sleepdrift: White Noise Mixer ("Sleepdrift", "the app"), an iOS application developed by MD Shahariar Nazim Joy ("we", "us", "the developer"). By downloading, purchasing, or using the app you agree to these Terms and to Apple's Standard EULA, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If you do not agree, do not use the app.

Where these Terms and the Apple Standard EULA address the same subject, the Apple Standard EULA governs your licence to use the app.

2. What Sleepdrift is

Sleepdrift is a white-noise and sleep-sounds app. It offers 54 sounds, all of which are synthesised on your device in real time by a built-in DSP engine — the app contains no audio recordings and no audio files. It provides a multi-track mixer with per-sound volume faders, a fade-out sleep timer, saved mixes, background audio, and Control Center support.

3. Purchase required

Sleepdrift requires a purchase to use. The app is behind a paywall and there is no free tier. You must hold an active subscription or the one-time Lifetime purchase in order to access the sounds and the mixer.

4. Subscription terms

Sleepdrift offers the following purchase options. Prices shown are US App Store prices and vary by region; the price applicable to you is the one shown in the app at the moment of purchase, in your local currency.

Auto-renewal

The Monthly and Yearly options are auto-renewing subscriptions. Payment is charged to your Apple Account at confirmation of purchase. Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.

Cancellation and management

You can manage your subscription and turn off auto-renewal at any time in Settings > Apple Account > Subscriptions on your device. Cancellation takes effect at the end of the current paid period — you keep access until then. Deleting the app does not cancel your subscription. The developer cannot cancel, refund, or modify your subscription on your behalf; only Apple can.

Free trial

The Yearly subscription includes a 3-day free trial. If you do not cancel at least 24 hours before the trial ends, it converts automatically into a paid Yearly subscription and your Apple Account is charged. If you purchase a subscription during a free trial period, any unused portion of that free trial is forfeited when you make the purchase. Free-trial eligibility is determined by Apple and a trial may be offered only once.

Lifetime purchase

The Lifetime option is a one-time, non-consumable in-app purchase. It does not auto-renew, there is nothing to cancel, and it grants access to the app on Apple Accounts eligible under Apple's terms. "Lifetime" refers to the lifetime of the app and its availability on the App Store, and does not constitute a guarantee that the app will remain available or supported indefinitely.

Payments, refunds and restoring purchases

All purchases are processed and managed by Apple, not by the developer. We never receive, see, or store your payment details. Refunds are handled solely by Apple in accordance with the App Store terms — request one at reportaproblem.apple.com. We are not able to issue refunds directly. You can restore an existing purchase on a new or reset device using the "Restore Purchases" option in the app, provided you are signed in to the same Apple Account used for the original purchase.

5. Not medical advice

Sleepdrift is not a medical device and makes no medical or health claims.

The app is intended for relaxation and general listening only. It is not intended to diagnose, treat, cure, prevent, or mitigate any disease, disorder, or medical condition, including insomnia, sleep apnoea, tinnitus, anxiety, ADHD, or any other condition. It has not been evaluated or approved by the U.S. Food and Drug Administration or by any other regulatory authority, and nothing in the app or on this website should be read as a claim to any therapeutic or clinical benefit.

Nothing provided by the app constitutes medical advice, and it is not a substitute for professional medical advice, diagnosis, or treatment. If you have a sleep problem or any other health concern, consult a qualified healthcare professional. Never disregard or delay seeking professional medical advice because of something you encountered in this app.

Hearing safety and safe use. Listen at a moderate volume; prolonged exposure to loud audio can damage your hearing. Do not use Sleepdrift while driving, operating machinery, or in any other situation where reduced awareness of your surroundings could be dangerous, or where you need to be able to hear alarms or warnings.

6. Licence and acceptable use

Subject to these Terms and to the Apple Standard EULA, you are granted a limited, non-exclusive, non-transferable, revocable licence to use Sleepdrift for your own personal, non-commercial purposes on Apple-branded devices that you own or control.

You may not: reverse engineer, decompile, or disassemble the app or its DSP engine except to the extent that applicable law expressly permits it; copy, redistribute, sell, sublicense, rent, or lease the app; remove or obscure any proprietary notices; or use the app in any unlawful way or in breach of the App Store terms.

7. Intellectual property

Sleepdrift, including its audio synthesis engine, design, and brand, is owned by the developer and protected by copyright and other laws. These Terms grant you no ownership rights in the app. All rights not expressly granted are reserved.

8. Privacy

Sleepdrift collects no data whatsoever and requests zero permissions. Settings and saved mixes are stored locally on your device and never leave it. See the Privacy Policy for the full detail.

9. Disclaimer of warranties

To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will produce any particular result, including any effect on your sleep.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these Terms limits your statutory consumer rights.

10. Limitation of liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or in connection with your use of, or inability to use, the app. Our total aggregate liability arising out of or relating to the app shall not exceed the amount you actually paid for it in the twelve months preceding the claim.

11. Third-party beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. You further acknowledge that Apple has no obligation to furnish any maintenance or support services with respect to the app, and that any claim relating to the app is a matter between you and the developer, not Apple, except as set out in the Apple Standard EULA.

12. Changes to the app and to these Terms

We may update the app, add or remove sounds or features, or modify these Terms. If we change these Terms materially we will update this page and revise the effective date above. Continued use of the app after a change constitutes acceptance of the revised Terms. Where a change to a subscription price applies to you, Apple will seek your consent in the manner required by the App Store terms before the new price takes effect.

13. Termination

These Terms apply until terminated. Your licence ends automatically if you fail to comply with them. You may terminate at any time by deleting the app — but remember that deleting the app does not cancel an active subscription; cancel it in Settings > Apple Account > Subscriptions.
