The terms you agree to when you use Bird Life List.

Bird Life List (“the App”) is a personal, offline birding life list for iPhone and iPad, published by MD Shahariar Nazim Joy. It lets you record bird sightings and view them as a life list, a map and a set of statistics.
Bird Life List requires a purchase to use. After a short setup flow, you must choose one of the plans below before the App’s features become available. There is no free tier, no advertising, and no other way to unlock the App.

All plans unlock exactly the same thing: full access to the sighting log, life list, sightings map, statistics, species browser and CSV export. Prices shown are for the United States App Store; the price in your country is shown in the App before you buy and is set by Apple’s regional pricing.
You can manage your subscription and turn off auto-renew at any time in Settings → your name → Subscriptions on your device, or directly at apps.apple.com/account/subscriptions. Deleting the App does not cancel a subscription.
If you reinstall the App, change device, or already subscribed with the same Apple Account, tap Restore Purchases — available on the plan screen and permanently in Settings → Subscription inside the App.
All purchases are processed by Apple. Refunds are handled by Apple under its own policies, not by us. Request one at reportaproblem.apple.com.
Subject to these terms and Apple’s Standard EULA, you are granted a personal, non-transferable, non-exclusive licence to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.
You may not: reverse engineer, decompile or disassemble the App except to the extent that applicable law expressly permits; rent, lease, lend, sell or redistribute the App; or remove any proprietary notices.
Your sightings are yours. We claim no ownership over the sightings, notes, locations or photos you record. Because the App has no server, your content is never uploaded to us, and we cannot access it. You are solely responsible for keeping your own backups — use Settings → Export life list (CSV).
The checklist bundled with the App was compiled originally for the App from public-domain ornithological nomenclature (vernacular names, binomial scientific names, family names). It is provided for the convenience of recording your own sightings.
Bird Life List is a personal record-keeping tool. It is not a bird identification service, it does not verify your sightings, and it is not a scientific or authoritative reference. It makes no claim of taxonomic completeness or currency. Do not rely on it for any regulatory, conservation, scientific or safety purpose.
To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that your data will never be lost.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of your use of the App. Our total aggregate liability shall not exceed the amount you actually paid for the App in the twelve months preceding the claim.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
These terms are between you and us, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.
This licence is effective until terminated. It terminates automatically if you fail to comply with any of its terms. On termination you must stop using the App and delete it.
We may update these terms. Changes are posted on this page with a new “Last updated” date. Continuing to use the App after a change means you accept the updated terms.
These terms are governed by the laws applicable in the jurisdiction of the publisher’s residence, without regard to conflict-of-law provisions, and without prejudice to any mandatory consumer-protection rights you have in your country of residence.
