Terms of Use

End User License Agreement (EULA) · Effective date: July 12, 2026

These Terms of Use ("Terms") form a binding agreement between you and MD Shahariar Nazim Joy ("we", "us", "the developer") governing your use of the iOS application GPA & Grade Tracker ("the App"). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, purchasing a subscription or one-time purchase for, or otherwise using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not download or use the App.

If you are under the age of majority in your jurisdiction, you may only use the App with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.

2. License Grant

Subject to your compliance with these Terms and your payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. This license is granted as a "Licensed Application End User License Agreement" in accordance with Apple's standard terms.

You may not: copy, modify, or create derivative works of the App; reverse engineer, decompile, or disassemble the App except to the extent such restriction is prohibited by applicable law; rent, lease, lend, sell, redistribute, or sublicense the App; or remove or alter any proprietary notices. The App is licensed, not sold, to you. We retain all right, title, and interest in and to the App, including all intellectual property rights.

You retain ownership of the content you enter into the App. Because the App stores your data only on your device, we claim no rights in it and have no access to it.

3. Purchases, Subscriptions & Auto-Renewal

The App requires a subscription or a one-time purchase in order to be used. The following options are offered:

All prices are shown in US dollars. The actual price you pay is charged in your local currency and may vary depending on your App Store storefront, applicable taxes, and Apple's exchange rates. The price applicable to you is the one displayed in the App at the time of purchase.

Auto-renewal terms

Lifetime Access

Lifetime Access is a one-time, non-consumable in-app purchase of $19.99. It does not renew and you will not be charged again for it. It unlocks the App's paid functionality for as long as the App remains available and supported on your Apple Account, and can be restored on your devices using "Restore Purchases" in the App's Settings.

Refunds

All purchases are processed by Apple. We cannot issue refunds directly. Refund requests are handled by Apple in accordance with Apple's policies. You can request a refund from Apple at https://support.apple.com/en-us/HT204084.

4. Academic Disclaimer — Please Read

The App is a calculator and organizer, not an official academic record.

All grades, percentages, letter grades, GPA figures, and projections shown in the App are estimates. They are calculated solely from the data you enter — your courses, categories, weights, scores, credit hours — and the grading scale you choose. If any of that input is incomplete, mistyped, or does not exactly match your institution's rules, the results will be wrong.

Schools, colleges, and universities differ in how they round, weight, drop lowest scores, handle incompletes and retakes, calculate credit hours, and compute GPA. The App cannot know or guarantee your institution's official method.

The App must not be relied upon for any official purpose, including but not limited to official transcripts, academic standing, athletic or program eligibility, financial aid, scholarship applications, honours determinations, or graduation decisions. Always confirm your actual grades and GPA with your school, instructor, or registrar. The developer accepts no responsibility for any academic, financial, or other decision made in reliance on figures displayed by the App.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You are solely responsible for the accuracy of the data you enter and for maintaining your own records. Because your data is stored only on your device, you are responsible for your own device backups; deleting the App deletes its data.

6. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CALCULATION IT PRODUCES WILL MATCH YOUR INSTITUTION'S OFFICIAL RESULT.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In that case, any statutory warranties you have are limited to the shortest period permitted by law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS, LOST OPPORTUNITY, OR ACADEMIC LOSS OR HARM, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so the above may not fully apply to you; nothing in these Terms limits liability that cannot be limited by law.

8. Termination

This license is effective until terminated. It terminates automatically, without notice, if you fail to comply with any provision of these Terms. You may terminate it at any time by deleting the App from your devices and cancelling any active subscription. Upon termination, you must cease all use of the App. Cancellation or termination does not entitle you to a refund except as provided by Apple's refund policy or as required by law. Sections 4, 6, 7, 9 and 10 survive termination.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of Bangladesh for any dispute arising out of or relating to these Terms or the App. If you are a consumer, this does not deprive you of the protection of any mandatory consumer-protection laws of your country of residence.

10. Apple's Standard EULA

In addition to these Terms, your use of the App is governed by Apple's Standard End User License Agreement (Licensed Application End User License Agreement), available at:

Apple is not a party to these Terms and has no obligation to furnish any maintenance or support for the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you. In the event of any conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA governs to the extent of the conflict.

11. Changes to These Terms

We may update these Terms from time to time — for example, if the App's features or pricing change. When we do, we will revise the effective date at the top of this page and post the updated Terms at this URL. Material changes will be posted here before they take effect. Your continued use of the App after an update means you accept the revised Terms. If you do not agree, stop using the App and cancel any active subscription.
